Most lawsuits are initiated by filing a petition or complaint in person or online (via myFLcourtaccess.com) and then getting your proposed summons issued/endorsed by the clerk of court. Depending on your specific circumstances, you may be required to file and serve additional documents such as a proposed case management plan, designation of email address, family court financial affidavit, etc.
According to § 48, Fla. Stat., proof of service is made prima facie by filing the affidavit or return of a certified process server, special process server, or deputy sheriff. For cases originating in Florida, I'll e-file proof of service on your behalf. If your case was filed out of state, I'll mail and/or e-mail you proof of service.
Service may be effected by publication under § 49, Fla. Stat. In some circumstances, a judge may allow substitute or alternative service upon granting the motion of a party. If I can't get your papers served, I'll e-file or send you an affidavit of non-service documenting my attempts.
If you can't find the defendant's home or workplace address using public records, you will have to pay an online skip trace provider or hire a licensed private investigator to discover one before I can serve your papers.
